GENERAL PROVISIONS OF TERMS AND CONDITIONS

These terms and conditions of www.elenas-therapy.com online shop are adopted in accordance with user data protection laws, consumer laws and other international codes of online shopping that are binding for Elenas d.o.o. as the provider of the services and products that are available on the online shop.

Terms and conditions determine the rights and obligations of the provider and the customer. These terms and conditions are binding for the customer as soon as he visits the online shop.

We advise you to get acquainted with these terms and conditions, because when you complete your purchase an assumption is made that you are acquainted with the terms and conditions and that you accept them completely without any restrictions. Before the completion of the purchase you have to agree to these terms and conditions in the check-out menu.

Elenas d.o.o. reserves the right at any time to update, change or replace the terms and conditions of the online store.

PRODUCTS AND SERVICES AVAILABLE IN THE ONLINE SHOP

The online shop www.elenas-therapy.com offers products and services that are described in detail on the web page www.elenas-therapy.com under the tab »Online shop«, including valid prices that are displayed in dollars or euros.

For the understanding of the provisions of these terms and conditions the term services includes; energy therapy and energy therapy for animals and the term products include; crystal bells, energy pendants for animals, energy pendants for necklaces, A book of energy Perception is power, energy rings, energy pictures etc.

For every purchase the currently displayed valid price is being charged.

Elenas d.o.o. reserves the right to change prices in the online shop without prior notification.

Elenas d.o.o. reserves the right at any time to modify or discontinue the services offered in the online shop without prior notice.

PLACING AN ORDER

Customers don’t have to register to place an order. Desired goods or services are placed in the cart from where the customer finishes the purchase with proceeding to check out where the customer fills in the necessary data for delivery and chooses a payment method.

Customers will receive confirmation on all orders as soon as the service provider receives the order. The sales contract between the customer and the provider is concluded as soon as the provider confirms the customer’s order. All orders placed must include the customer’s basic information: first name, last name, e-mail address, phone number, shipping address (street address, town, zip code, state). Keep in mind that conclusive information helps the ordering and shipping process run smoother.

SHIPPING AND DELIVERY

The online shop www.elenas-therapy.com is based in Slovenia, EU and is made exclusively for international purchases from US, EU countries, and other non-EU countries.

Shipments are normally delivered in 1-2 weeks for EU countries, and 4-6 weeks for non-EU countries. All shipments are handled and delivered by the GLS delivery company (EU countries) or The postal office of Slovenia (non-EU). Shipping costs are as per price list of the delivery company and are added to the full charged price when the customer chooses the region of shipping in checkout.

Please note that we don’t deliver packages to Postal office box addresses or hotel addresses and similar, because we aim to deliver packages to your home address with couriers who will get in touch with you before delivering your package.

Elenas d.o.o. is not responsible for any potential shipping delays caused by the delivery company or unpredictable and unpreventable circumstances.

Elenas d.o.o. does reserve the right to change the delivery provider in order to improve and/or optimize the shipping process.

PAYMENT

Outside of Slovenia, payment is only available through a Proforma invoice or by Credit card (direct bank transfer or Paypal). Customers choose their payment method in the checkout.

Any potential customs payments in countries outside the EU (if such legislation exists) are covered by the custumer.

RETURNS AND REFUNDS

Returns of purchased products

All purchased products in www.elenas-therapy.com online shop are carefully inspected before shipping and are shipped undamaged and in perfect condition. You are obliged to inspect the delivered product as soon as you get it delivered and immediately inform Elenas d.o.o. about any damaged products (info@elenas-therapy.com).

Customers have the right to return purchased products without specifying a reason, but in accordance with the following provisions.

Customers are obliged to inform us (info@elenas-therapy.com) about any potential returns within 15 days after receiving the purchased product.

Any return costs are covered by the customer. The received products must be shipped back to Elenas d.o.o. within 30 days from the delivery date.

The returned products have to be returned unused, undamaged and in the original undamaged packaging. If not so, Elenas d.o.o. will not be able to grant you a full refund, but will have to decrease the refund for the expense that emerges from damaged or used products or products returned in damaged packaging.

Returns are not possible without the product’s receipt.

The refund will be possible when the product is delivered back to Elenas d.o.o..

Elenas d.o.o. is bound to return any payments in a period of 15 days after all the terms and conditions as described above have been met.

Refunds of purchased services

Regarding purchasing a service (energy therapy and energy therapy for animals) on the www.elenas-therapy.com online shop the consumer explicitly agrees to give up the right to claim a refund of the purchased service, if the service was completely fulfilled by Elenas d.o.o..

This previous provision is consistent with the consumers rights act of Republic of Slovenia (Consumer Protection Act) under two conditions; first, the consumer must explicitly agree to give up the right to a refund for the service and secondly, the service from the concluded purchase must be completely fulfilled. (see 4th  point of 5th paragraph of 43rdč article of the Consumer Protection Act)

PRIVACY

Elenas d.o.o. as the administrator of personal data guarantees that the company will protect the confidentiality of personal data and privacy of all online store users. The collected personal data will be used exclusively for Administrators Services. The Administrator shall respect the confidentiality of personal data and privacy of users of the online store, and will do everything necessary to protect the data against any potential violations and abuses. Personal data of the users are one of the areas to which we pay the utmost care and attention, as we are aware of the sensitive nature of this area.

For operating purposes, the Administrator collects, stores and uses the following personal user data:

Elenas d.o.o. is not responsible for any incomplete, incorrect or updated information filled in by user.

COOKIES & IP ADDRESS

At the beginning of each use of the respective application, the Administrator assigns a cookie to identify the Web store, shopping baskets and to ensure traceability (the so-called “cookie”), which only stays in the memory of the store’s server for the duration of the visit of the online store, and is instantly deleted after one hour of inactivity. The Administrator may also store some persistent cookies on the users’ personal computer, for example: the identification number of the user in encrypted form to identify the next time you visit our online store or review items, through which the user knows which items they’ve already rated and reviewed, as well as cookies from Google Analytics, which serve the analysis of visits on the Web site. The Administrator can use the data in an anonymized summary form for the purposes of statistical analysis. For the purposes of ensuring the safety of the Online store, the Administrator also collects IP addresses from which users access the online store.

USER DATA & PRIVACY DECLARATION

The Administrator is, in accordance with the rules governing the protection of personal data, committed to the protection of personal data of the users of its online store. The Administrator will not, under any circumstances & without the direct permission of the user, supply personal or other user data to a third party, and will not allow third party access to personal or other user data, unless required by State authorities, or in the good faith belief that such action is necessary for the proceedings in court or other public authorities, as well as for the protection and legitimate interests of the Administrator.

All personal and other data provided by the user when registering an account in the online store, as well as orders and purchases, including the contents of the orders, will be protected in accordance with the rules governing the protection of personal data. The Administrator will not use this information for any purposes which could potentially harm the user or others involved in any way. The Administrator will not use this information to send promotional e-mails or other unsolicited promotional material, except for those promotional notices, to which the user has agreed to. The Administrator may use the data in an anonymized summary form for the purposes of statistical analysis. The confidentiality of personal and other user data will not be violated in any form.

The Delivery service (e.g. Post of Slovenia, DHL, UPS, etc.) will only be trusted with the information necessary for the delivery of the products purchased in the online shop (data of the recipient and the address for delivery). The Administrator will contact users via e-mail if it is necessary for the execution of a purchase in the online shop, or via phone – only if there is a problem in the process of registration or purchase in the online store.

THE IMPLEMENTATION OF PRIVACY POLICY

All regular or part-time employees who have access to personal and other data users have the duty to protect personal and other data, and are obliged to take account of those provisions on the protection of the confidentiality of personal data and the privacy of the users of the online store. The duty to protect personal and other data applies even after any potential termination of the relationship between the Administrator and its employee.

Registered users may stop using the Online store at any time and cancel their registration on the Administrator’s website. To do so, users are obliged to inform the Administrator in a written statement, by e-mail, of their registration cancelation. Before passing the statement on cancellation of the users’ registration, the user is obliged to settle all outstanding obligations they may have from purchasing in the online store. The Administrator will enforce data privacy and confidentiality even after the registration cancellation.

These Terms of Service and any separate agreements whereby Elenas d.o.o. provides you services or products shall be governed by and construed in accordance with the laws of Slovenia.
